WHO MAY BE A DEBTOR IN CHAPTER 7 OR CHAPTER 13

  • Only a person who resides or owns property in the United States can be a debtor.
  • For a Chapter 13 petition, only an individual with regular income can be a debtor.
  • A married couple may file for bankruptcy either individually or jointly.

Chadds Ford Debt Lawyer: What Is The Credit Counseling Certificate

A Credit Counseling Certificate must be obtained before the Chapter 7 or Chapter 13 Bankruptcy petition can be filed.  All individual debtors and each spouse in a joint petition must undergo Credit Counseling.

This Credit Counseling must occur 180 days before you file your petition.  The counseling may take place in person, over the phone, or online.  The pre-petition certificate will cost between $15 – $45.

Those with a mental or physical incapacity and those on active military duty in a combat zone are excused from this requirement.  Otherwise, the Credit Counseling certificate must be filed with your initial Chapter 7 or 13 petition. Chadds Ford Debt Attorney: What Is The Debtor Education Certificate

The Debtor Education Certificate or the Financial Management Certificate provides instruction in personal financial management.  While the pre-petition Credit Counseling Certificate focuses on your existing debt, the post-petition Debtors Education Certificate focuses on how to budget and manage your finances for the future.

  • If you file a Chapter 7 Bankruptcy petition, you must obtain and file your Debtors Education Certificate within 60 days of your creditors meeting.
  • If you file a Chapter 13 Bankruptcy petition, you must obtain and file your Debtors Education Certificate before you make your last plan payment.
  • Those with a mental incapacity, a physical disability, or on active military duty in a war zone, are excused from this requirement.
