How is marital property divided in divorce?

When an Upper Darby, PA couple divorce, their marital property is subject to equitable distribution by the court.  If a divorcing couple cannot agree on a division of marital property, either or both spouse should consult with an experienced family law lawyer.

Upper Darby Divorce Lawyer – What is marital property?

Marital property is that property acquired during the marriage or acquired with marital assets.  Marital property also includes any increase in value of the marital property which occurred during the marriage.  Marital property is either real property, such as a home, condo, or vacation home.  It is also personal property, such as a car, bank account, or jewelry.  Marital property also includes any debt acquired by the couple during their union.

How is marital property equitably distributed in divorce?

First, it is best for the divorcing couple to reach an agreement on the division of their marital wealth and debts.  If the divorcing couple cannot agree, the court will divide their wealth and debt by applying the principles of equitable distribution.  This means the court will divide the wealth and debt fairly—or in such proportions and such manner ‘as the court deems just’.

Second, in PA, equitable distribution or the fair division of marital property does not mean that the couple’s wealth and debt will be split 50-50.

Third, there are many factors a court will consider when deciding the fair distribution of marital property.  The length of the marriage and the existence of prior marriages are considered.  Obviously, the age, health, income, work skills, and needs of each spouse are considered.  Whether either spouse contributed to the other’s education or training is considered.  The couple’s standard of living during their marriage is a factor.  The value of non-marital property owned by either spouse is also a factor.

Other factors considered during the equitable distribution of marital property is whether either spouse has custody of any children.  Also considered is whether either party contributed to an increase or decrease of the value of marital property.  This factor includes the situation where one spouse was the primary homemaker during the marriage.

Finally, the particular situation of each spouse is considered.  That is, the income source, medical needs, insurance policies, and retirement plans, together with the prospect of future assets or income, are considered.  The financial situation of the parties at the time of the distribution, such as tax consequences and costs associated with the sale or distribution of the property are considered.

Upper Darby Workers Compensation Claims

First, negligence is not necessary in order to present a Worker’s Comp claim.  This means that no one needs to be ‘at fault’ for your injury.  As long as you were injured on the job you have a right to present a Worker’s Comp claim.

A work injury is defined as any injury, medical condition, or disease that is caused by the worker’s job or occurred in the course or scope of his or her employment according to the PA Worker’s Compensation Act.

For example, if a delivery person was injured while loading his or her delivery truck, that injured delivery person may file a Worker’s Comp claim.  The act that caused the injury need not be proved by witnesses of photographs as long as the injured delivery person suffered the injury on the job and reported the injury to his or her employer.

The injury could happen simply by bending over or reaching overhead while stocking shelves in a grocery store.  The injury could happen by falling off of a shaky contractor’s ladder while working on a home.  The injury could happen if the worker simply closed a car door on his or her hand while making a delivery in Upper Darby, PA.  And, of course, the injury could happen in a car accident in Upper Darby while the driver was in the course and scope of his or her employment.  When these injuries happen, it is helpful to have our Upper Darby Workers Compensation lawyer fighting for you.

Upper Darby Worker’s Comp Lawyer

The point is that ‘fault’ for the injury is not a necessary element for an injured worker to present a Worker’s Comp claim.  The worker simply needs to have been injured on the job or while in the course and scope of his or her employment.

As an experienced Upper Darby Worker’s Compensation attorney, Michael T. Malarick, Esquire, will explain the Worker’s Comp rules and guide you through the Worker’s Comp process in order for you – the injured Upper Darby worker – to get full compensation for your workplace injury.

Upper Darby Slip & Fall Attorney

Determining a slip and fall case:

A Slip and Fall case can arise whenever someone slips, trips, tumbles or falls and injures themselves on someone else’s property.  You can injure yourself by slipping on ice or snow in the parking lot of an Upper Darby store.  You can injure yourself by tripping over an uneven or cracked sidewalk in front of an Upper Darby home.  You can injure yourself by stumbling due to debris on the steps of an Upper Darby apartment.  You can injure yourself by falling over any unexpected obstacle that is on the property of another.

If you injure yourself on someone else’s property, you should contact Michael T. Malarick, Esquire, an experienced Slip and Fall attorney, who will investigate, litigate or settle your claim.

Understanding slip and fall injuries and damages:

Slip and Fall damages are any injuries you may suffer as a result of your Slip and Fall incident.  The injury may be neck and back strains and sprains.  The injury may be a fractured ankle or broken arm.  The injury may be a chipped tooth or head concussion.  Whatever your physical injury, you are entitled to be compensated for the pain and suffering you endured.

Along with the compensation you receive for the pain and suffering you endure, a slip and fall injured plaintiff is also entitled to be made whole.  That is, if the injured person lost work because of the slip and fall injury, he is entitled to his lost wages.  If the injured person paid for medical treatment because of the slip and fall injury, she is entitled to that amount paid out of pocket.

If you are injured in a slip and fall incident on someone else’s property in Upper Darby, PA, Michael T. Malarick, will ensure that you get fully compensated for all of your injuries.  Contact our Delaware County slip and fall attorney today.

As an experienced Upper Darby car accident lawyer, Michael T. Malarick, Esquire, has successfully handled car accident claims on behalf of Upper Darby car accident victims.  Many drivers have selected the “limited tort” option of automobile insurance in order to save money on insurance premiums.  This selection limits the ability of the named insured and his resident relatives to sue and recover for ‘pain and suffering’—unless they suffered a significant injury. Call: 610-816-6683

However, there are exceptions to the ‘limited tort’ selection.  These include an auto accident with a commercial vehicle, such as a delivery truck or a contractor’s van; a bus, taxi, or car for hire, such as a SEPTA bus, trolley or an Uber cab; a tractor-trailer; a car operated by someone convicted of a DUI (Driving Under the Influence of alcohol or drugs): an accident with a motorcycle; or an accident with an out of state vehicle ( a car registered outside of PA).

When you make the ‘limited tort’ selection on your auto insurance policy, you give up the right to sue for pain and suffering unless you suffer a serious injury or a permanent disfigurement.  It will not matter if the other driver is 100% at fault for the car crash.

Auto Accident Injuries

A serious injury is defined as a death; a serious impairment of a bodily function; or a permanent serious disfigurement.  As an experienced Upper Darby car accident lawyer, Michael T. Malarick, can assist the Upper Darby car crash victim with a ‘limited tort’ insurance policy who has been injured by the negligence of the other driver.

If you are involved in a motor vehicle accident and you have made the ‘limited tort’ selection on your car insurance, contact Michael T. Malarick, an experienced Delaware County car accident lawyer who will thoroughly examine the facts of your car crash in and around Upper Darby, in order to present a claim for your injuries.  Call today and allow our law office to fight for you.
