When does worker’s compensation coverage begin?

If an employee’s work causes injury, illness, or disease, the employee is entitled to worker’s compensation benefits.  Worker’s compensation coverage begins on the date of hire.  Worker’s compensation medical benefits also begin on the date of hire.  Wage loss benefits begin after a seven (7) day waiting period from the date of injury.  That is, wage loss benefits are payable on the eighth day following the date of injury.  However, once the employee is out of work for fourteen (14) days, the employee will receive retroactive pay for the seven (7) day waiting period.

What must the worker do after an injury, illness, or disease?

First, PA law states that “…no person shall operate or ride upon a motorcycle … unless he is wearing protective headgear”.  75 Pa. C.S. 3525.  However, there are exceptions to the PA Motorcycle Helmet Law.  These exceptions from the helmet law include:

  1. A person 21 years old who has had a motorcycle license for 2 full years;
  2. A person 21 years old who has completed an approved motorcycle rider safety course; and
  3. A 21 year old passenger if the motorcycle operator is excepted from the helmet law.

Second, the PA Helmet Law also states that “No person shall operate or ride upon a motorcycle… unless he is wearing an approved eye-protection device”.

Finally, if a person only has a motorcycle learner’s permit, a helmet must be worn regardless of their age.

The helmet or eye-protection must be U.S. Department of Transportation approved.  The approved helmet or eye-protection will have a DOT sticker identifying the make, model, size, and the month and year it was manufactured.

A Change to Pennsylvania’s Divorce Law

As of December 3, 2016, Pennsylvania’s Divorce law has changed.  Pennsylvania’s two (2) year waiting period for divorce based upon the irretrievable breakdown of the marriage has been reduced to one (1) year.  This change in the waiting period applies to divorce actions filed after December 3, 2016.  That is, if you filed for divorce on December 1, 2016, and alleged the irretrievable breakdown of the marriage, you must wait the full two (2) years before obtaining a divorce decree.  However, if you filed on December 4, 2016, and alleged irretrievable breakdown, you will only have to wait one (1) year.
