A Change to Pennsylvania’s Divorce Law
As of December 3, 2016, Pennsylvania’s Divorce law has changed. Pennsylvania’s two (2) year waiting period for divorce based upon the irretrievable breakdown of the marriage has been reduced to one (1) year. This change in the waiting period applies to divorce actions filed after December 3, 2016. That is, if you filed for divorce on December 1, 2016, and alleged the irretrievable breakdown of the marriage, you must wait the full two (2) years before obtaining a divorce decree. However, if you filed on December 4, 2016, and alleged irretrievable breakdown, you will only have to wait one (1) year.
Pennsylvania’s other ‘no-fault’ ground for divorce – mutual consent – remains unchanged. That is, if both spouses agree to the divorce, the waiting period remains 90 days.
